The People of the State of California, by and through Mara W. Elliott, City Attorney of San Diego vs.

Maplebear Inc. dba Instacart and Does 1-20 inclusive 

You may be eligible to receive a cash payment as part of a settlement reached between the City Attorney of San Diego on behalf of the People of the State of California and Instacart to resolve claims related to alleged Shopper misclassification, and to provide restitution to Instacart Shoppers, in California. The payment amount is based on the total hours you worked as a Shopper in California between September 13, 2015 and December 15, 2020 according to Instacart’s records, and will be paid out of a fund set up as part of that settlement. 

The San Diego City Attorney, has hired Simpluris to administer these payments.

In September 2019, San Diego City Attorney Mara W. Elliott filed an Unfair Competition Law lawsuit against Instacart, on behalf of the People of the State of California, alleging Instacart misclassified Shoppers as independent contractors instead of employees. Instacart has denied liability. But in December 2022, the San Diego City Attorney reached a settlement on behalf of the People with Instacart in which Instacart agreed to establish a fund for restitution payments to be made to Instacart Shoppers who performed work in California based on the total hours worked in California between September 13, 2015 and December 15, 2020.

Please note this settlement resolves a public law enforcement action brought by the San Diego City Attorney on behalf of the People of the State of California against Instacart. If you choose to submit a claim for payment, you will not be required to enter into any separate agreement or separate settlement with Instacart.
